Retrospective Outbuilding, Surrey

Application Type:
Retrospective

Sector:
Residential

Location:
Surrey

Project Overview

Warner Planning was instructed to submit a retrospective planning application for a residential property in Surrey, seeking to retain an existing rear outbuilding along with associated fencing and gates.

The site had a complex planning history, including previous extensions and an earlier retrospective application for a 3m-high boundary fence, which had been refused due to concerns about its visual impact and relationship with neighbouring properties.

The outbuilding had also evolved from an existing garage and included a bathroom and separate access, meaning careful consideration was required to demonstrate that it remained ancillary to the main dwelling rather than functioning as an independent residential unit.

A significant factor in the decision was the reduction of the rear fence from 3m to approximately 2m. This directly addressed the Council’s previous concerns about the fence being visually intrusive and dominating the site. The revised fencing, together with the approximately 2.4m-high outbuilding, was considered proportionate and acceptable.

The outbuilding was also accepted as an ancillary structure, with a planning condition imposed to ensure that this remained the case and to protect neighbouring residential amenity.

Following amendments and engagement with the Council during the application process, retrospective householder planning permission was granted, subject to conditions.

The decision demonstrates the importance of understanding a site’s planning history, responding constructively to previous concerns and carefully defining the use and relationship of ancillary buildings within residential schemes.
